These Terms & Conditions apply to the sale and delivery of products and services provided by RockyNordic ApS, CVR number 40440712.
The terms apply from 10 January 2023 and cover the use of RockyNordic’s hosting, domain, server, subscription, and related services.
This agreement is entered into between RockyNordic ApS and the customer.
The agreement becomes active when the customer, or a representative acting on behalf of the customer, submits an order to RockyNordic.
By ordering, using, renewing, or paying for a RockyNordic product or service, the customer accepts the applicable Terms & Conditions.
For the purpose of these Terms & Conditions, the following definitions apply:
Customer means the person or company listed as the owner of the product in RockyNordic’s systems.
Registrant means the person or organization that has registered a domain name.
Product means web hosting, domains, server solutions, and other related services or goods offered by RockyNordic.
Domain means the address used to point to a device or service connected to a network, such as the internet.
DNS means Domain Name System, which is used to connect domain names with IP addresses.
Registrar means the party responsible for handling domain registration on behalf of the registry.
Registry means the organization responsible for managing a specific domain extension.
Traffic means the data used when information is sent to or from a device, server, website, or service.
RockyNordic may request documentation from the customer when needed to verify ownership, identity, or authorization before changes are made to a product.
If the customer does not respond to requests from RockyNordic, this may be considered a breach of contract.
RockyNordic may temporarily suspend access to a service when maintenance, updates, or operational work is necessary. RockyNordic will try to perform such work at times that cause the least possible inconvenience.
RockyNordic may update these Terms & Conditions. Any changes will take effect 30 days after publication on RockyNordic’s website.
Payment of an invoice is considered acceptance of the Terms & Conditions applicable at the time of payment.
Products are normally created immediately after ordering or as soon as possible thereafter.
Because of this, there is generally no right of withdrawal unless clearly stated for a specific product.
There is no right of withdrawal for domains, as RockyNordic’s cost becomes binding at the time of ordering.
RockyNordic’s products and services must not be used for unsolicited email, spam, illegal material, abusive activity, or other unwanted use.
If the customer breaches the Terms & Conditions, RockyNordic may delete material, suspend the product, or close the product without notice in serious cases.
Any remaining subscription period will not be refunded in case of breach.
RockyNordic retains ownership of delivered goods and services until the full amount has been paid, including any fees, interest, shipping costs, or collection costs.
For shared hosting products, the customer may not operate multiple unrelated websites within the same product unless this has been approved in writing by RockyNordic.
Applications or services running on shared servers must not use an unreasonable amount of server resources.
RockyNordic may stop applications or services that negatively affect server performance or other customers.
Shared hosting should not be used for storing sensitive personal data unless the customer has taken proper security measures. RockyNordic recommends dedicated server solutions for sensitive or business-critical data.
For dedicated hosting, including virtual servers, physical servers, and colocation, costs for traffic, power, and cooling may be added according to current cost prices plus administration fees.
If a customer’s systems are attacked or affected by external circumstances outside RockyNordic’s control, RockyNordic may invoice the time spent resolving or reducing the impact.
Products may be provided with measured traffic usage or free traffic.
For products with free traffic, usage must follow normal patterns. Free traffic may not be used for large file distribution, illegal material, offensive material, mass downloads, or similar high-volume use.
RockyNordic decides whether traffic usage is considered normal or outside the permitted use.
To create a subscription, the customer must be of legal age.
RockyNordic may reject orders or refuse to renew a subscription.
The customer is responsible for keeping contact and billing information updated in RockyNordic’s systems. A valid postal address is required.
Subscriptions renew automatically unless cancelled in time.
Product changes for the next subscription period must be received no later than 30 days before the end of the current subscription period.
Domains must be cancelled no later than 60 days before expiration.
Virtual servers and VPS services are subject to 3 months’ notice before termination.
Cancellations must be made in writing through RockyNordic’s systems.
Private subscriptions require a valid date of birth.
Business subscriptions require a valid CVR number.
If cancellation is made too late, the applicable subscription period may still be invoiced according to RockyNordic’s current prices and terms.
RockyNordic cannot guarantee that a desired domain name can be registered.
Most domains are registered on a first-come, first-served basis. RockyNordic is not responsible if a domain is registered by another party before the order is completed.
The customer is responsible for ensuring that domain ownership and contact information are correct and updated.
If the customer’s information is incorrect, RockyNordic may choose not to renew the domain.
The registrant must follow all rules set by ICANN and the relevant domain registry.
If domain payment is not made, RockyNordic may deactivate the domain and transfer ownership to RockyNordic.
Transfer of certain domains may be restricted for a period after registration according to ICANN or registry rules.
The customer is fully responsible for the use of the product.
This also applies if a third party gains access through the customer’s username, password, or other credentials.
The product must not be used to gain unauthorized access to RockyNordic’s systems or third-party systems.
The customer is responsible for maintaining websites, applications, code, data, updates, and backups unless otherwise agreed.
The customer is also responsible for ensuring that all installed software is properly licensed.
RockyNordic is responsible for submitting the zone file to the relevant registry when acting as registrar.
RockyNordic is not responsible for third-party services that are unavailable or not functioning.
RockyNordic is not responsible for direct or indirect losses, including loss of profit, operational loss, loss of time, data loss, reduced uptime, spam, or security issues, unless otherwise required by law.
RockyNordic is not responsible for the customer’s website content. The customer’s content must comply with applicable law.
If RockyNordic can be held liable, liability is limited to losses caused by intentional or grossly negligent actions or omissions by RockyNordic or RockyNordic employees.
Any liability will be limited to a proportionate part of the current prepaid quarterly subscription fee for the affected product.
Failure to pay on time may result in interest, reminders, reminder fees, suspension, debt collection, or reporting to a credit information agency.
RockyNordic may change prices for domain renewals and domain changes. Current prices are listed on RockyNordic’s website.
For payment card payments, a recurring automatic payment is generally created, so the subscription can be charged automatically upon renewal.
Any transaction fees related to the chosen payment method are the responsibility of the customer.
RockyNordic does not disclose customer information to third parties without permission unless required by law.
Domain-related customer and registrant information may be sent to registries, registrars, and WHOIS databases where required by ICANN or registry rules.
The customer is responsible for ensuring that all information provided to RockyNordic is correct and approved by the relevant person or company.
RockyNordic will take reasonable precautions to protect personal data against misuse.
The customer is responsible for ensuring that all software stored, installed, or used on RockyNordic products is properly licensed.
Some products may include licensed software where RockyNordic handles licensing. The customer must follow the relevant license terms for such products.
If a dispute arises between the customer and RockyNordic regarding these Terms & Conditions, RockyNordic will inform the customer of the nature of the dispute within a reasonable time if requested in writing.
RockyNordic is not responsible for failure or delay caused by circumstances outside its control.
This includes, but is not limited to, war, mobilization, riots, natural disasters, pandemics, strikes, lockouts, supply shortages, fire, transport issues, currency restrictions, import or export restrictions, illness or resignation of key personnel, viruses, or similar circumstances beyond RockyNordic’s control.
These Terms & Conditions are governed by Danish law.
Any dispute between the customer and RockyNordic relating to these Terms & Conditions or RockyNordic’s products shall be settled by the Court of Aarhus.
